1. Performance Modifications & Warranty Disclaimer
1.1 Manufacturer Warranty Voidance
WARNING: Performance modifications, including but not limited to engine tuning, exhaust modifications, ECU remapping, and aftermarket parts installation, MAY VOID YOUR MANUFACTURER'S WARRANTY.
Customers acknowledge that:
- Manufacturer warranties may be partially or fully voided by modifications
- Dealerships may refuse warranty claims on modified motorcycles
- We are not responsible for any warranty claims denied due to modifications we performed
- Customers should consult their manufacturer's warranty policy before authorizing modifications
1.2 Performance Expectations
Dyno tuning, performance upgrades, and custom builds are performed to maximize performance based on current conditions and parts. However:
- Actual performance gains may vary based on riding conditions, fuel quality, altitude, temperature, and rider skill
- Dyno results are measured under controlled conditions and may not reflect real-world performance
- We do not guarantee specific horsepower, torque, or speed increases
- Performance may degrade over time due to normal wear, environmental factors, or improper maintenance
1.3 Fuel Requirements
Performance-tuned motorcycles may require higher-octane fuel than stock. Using incorrect fuel can result in:
- Engine knock or detonation
- Reduced performance or engine damage
- Voided warranty on our tuning services
Customers are solely responsible for using appropriate fuel as specified during service.
2. Street Legality & Emissions Compliance
2.1 Emissions Modifications
IMPORTANT: Some performance modifications, particularly exhaust and emissions-related modifications, may render your motorcycle non-compliant with federal, state, or local emissions regulations.
Customers acknowledge that:
- Modified motorcycles may fail emissions testing required for registration
- Some modifications are legal for "off-road use only" or "competition use only"
- It is the customer's responsibility to ensure their motorcycle complies with all applicable laws
- We are not liable for fines, penalties, or registration issues resulting from modifications
2.2 Noise Regulations
Aftermarket exhausts and performance modifications may increase noise levels beyond legal limits in some jurisdictions. Customers are responsible for:
- Verifying compliance with local noise ordinances
- Any citations or fines for excessive noise
- Installing baffles or restrictors as required by law
2.3 "Off-Road Use Only" Modifications
Certain parts and modifications are labeled "For Off-Road Use Only" or "Not Legal for Street Use." By authorizing installation of such parts, customers acknowledge:
- The motorcycle may not be legally operated on public roads
- These modifications are intended for closed-course competition or private property use only
- Customers assume all legal liability for operating modified motorcycles on public roads
3. Safety & Risk Acknowledgment
3.1 Increased Performance = Increased Risk
Performance modifications increase the capabilities of your motorcycle, which correspondingly INCREASES THE RISK OF INJURY OR DEATH if operated improperly.
Customers acknowledge that:
- Higher speeds reduce reaction time and increase accident severity
- Modified handling characteristics require adjustment and skill development
- Increased power can overwhelm traction, especially in wet or poor conditions
- Racing or aggressive riding on public roads is illegal and extremely dangerous
3.2 Proper Use & Training
We STRONGLY RECOMMEND that customers with performance-modified motorcycles:
- Take advanced rider training courses (MSF Advanced Rider Course or similar)
- Practice in controlled environments before riding aggressively
- Always wear appropriate safety gear (DOT-approved helmet, jacket, gloves, boots)
- Understand the capabilities and limits of their modified motorcycle
- Never exceed posted speed limits or ride beyond their skill level
3.3 Track Day & Racing Use
Motorcycles modified for competition use should be operated on closed courses or racetracks only. Track use requires:
- Proper safety gear (leather suit, back protector, racing boots, gloves)
- Track day insurance or waiver acceptance
- Understanding of racing flags and etiquette
- Technical inspection as required by track or sanctioning body
4. Custom Builds & One-Off Projects
4.1 Unique Nature of Custom Builds
Custom motorcycle builds are unique, one-of-a-kind projects. By commissioning a custom build, customers acknowledge:
- Each build is experimental and may have unforeseen characteristics
- Custom motorcycles may handle differently than factory motorcycles
- Parts availability for future repairs may be limited or nonexistent
- Resale value is unpredictable and may be lower than investment
- Aesthetic results are subjective; we strive for excellence but cannot guarantee customer satisfaction with appearance
4.2 Testing & Break-In Period
Custom builds and heavily modified motorcycles require a break-in period. Customers must:
- Follow all break-in instructions provided at delivery
- Return for follow-up inspections as recommended (typically 100, 500, and 1000 miles)
- Report any unusual noises, vibrations, or handling characteristics immediately
- Avoid aggressive riding during the break-in period
4.3 Title & Registration
Customers are responsible for all title and registration requirements for custom builds. We provide documentation of parts and services, but we are not responsible for:
- DMV approval or rejection of custom builds
- Obtaining title for custom frames or heavily modified motorcycles
- Meeting specific state requirements (e.g., VIN inspections, special titles)
5. Maintenance & Upkeep Responsibilities
5.1 Increased Maintenance Requirements
Performance-modified motorcycles typically require MORE FREQUENT MAINTENANCE than stock motorcycles. Customers are responsible for:
- Following recommended maintenance schedules (often more frequent than stock)
- Using specified fluids, fuel, and parts
- Inspecting critical components regularly (chains, brakes, suspension, tires)
- Addressing any issues promptly to prevent damage
5.2 Failure to Maintain
Failure to properly maintain a modified motorcycle can result in:
- Catastrophic mechanical failure
- Voided warranty on our services and parts
- Unsafe operating conditions
- Expensive repairs
We are not liable for damages resulting from improper maintenance, neglect, or abuse.
6. Insurance Considerations
6.1 Notify Your Insurance Company
CRITICAL: Customers MUST notify their insurance company of any modifications. Failure to disclose modifications may result in:
- Denial of claims
- Policy cancellation
- Accusations of insurance fraud
6.2 Custom Parts & Equipment Coverage
Standard motorcycle insurance may not cover the full value of custom parts and modifications. We recommend:
- Obtaining "custom parts and equipment" coverage
- Providing your insurance company with documentation of all modifications and their values
- Reviewing coverage limits to ensure adequate protection
6.3 Track Day Insurance
Standard insurance policies typically DO NOT COVER accidents occurring on racetracks. Customers should obtain specialized track day insurance if planning to use their motorcycle for competition or track days.
7. Parts & Materials Disclaimer
7.1 Aftermarket Parts
We use high-quality aftermarket parts from reputable manufacturers. However:
- Aftermarket parts may not meet the same standards as OEM parts
- Fit and finish may vary
- Long-term reliability may differ from OEM components
- Parts warranties are provided by manufacturers, not Refugee Cycles
7.2 Customer-Supplied Parts
If customers supply their own parts for installation, we:
- Do not warranty the parts themselves
- Are not responsible for quality, authenticity, or compatibility
- Reserve the right to refuse installation of substandard or incompatible parts
- Warranty our labor only, not the customer-supplied parts
7.3 Used & Salvage Parts
When used or salvage parts are installed at customer request:
- No warranty is provided on the parts
- Condition and longevity cannot be guaranteed
- We inspect used parts but cannot guarantee they are free from defects
