1. Acceptance of Terms
Welcome to Refugee Cycles. By accessing our website at refugeecycles.com (the "Site") or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Refugee Cycles ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
2. Services Provided
Refugee Cycles provides the following services:
- Custom Motorcycle Builds: Design, fabrication, and assembly of custom motorcycles
- Dyno Tuning: Performance testing and fuel mapping services
- Performance Upgrades: Installation and modification of performance parts
- Buell Dealership Services: Sales, service, and parts for Buell motorcycles
- Repair & Maintenance: General motorcycle repair and maintenance services
- Consultation: Custom build planning and performance consulting
3. Service Agreements & Quotes
3.1 Written Estimates
All services require a written estimate or quote before work begins. Estimates are valid for 30 days unless otherwise specified. Prices are subject to change based on parts availability and unforeseen complications.
3.2 Project Scope Changes
Any changes to the agreed-upon scope of work must be approved in writing and may result in additional charges. We will notify you of any necessary changes and obtain approval before proceeding.
3.3 Timeline Estimates
Project timelines are estimates only and are subject to change based on parts availability, unexpected mechanical issues, and workload. We are not liable for delays beyond our reasonable control.
3.4 Custom Build Deposits
Custom build projects require a non-refundable deposit of 50% before work begins. The remaining balance is due upon project completion before the motorcycle is released to the customer.
4. Payment Terms
4.1 Accepted Payment Methods
We accept cash, credit cards (Visa, Mastercard, American Express, Discover), debit cards, and bank transfers. A 3% processing fee may apply to credit card transactions over $1,000.
4.2 Payment Schedule
- Repair Services: Payment due upon completion
- Custom Builds: 50% deposit, balance due on completion
- Dyno Tuning: Payment due upon completion
- Parts Orders: Payment required at time of order
4.3 Late Payment
Payment is due immediately upon completion unless other arrangements have been made in writing. Late payments (30+ days overdue) are subject to a 1.5% monthly interest charge. Motorcycles will not be released until payment is received in full.
4.4 Storage Fees
Motorcycles not picked up within 7 days of completion notification are subject to a storage fee of $25 per day. After 60 days, we reserve the right to place a mechanic's lien on the vehicle.
5. Warranty & Guarantees
5.1 Workmanship Warranty
We guarantee our workmanship for 90 days from the date of service completion. This warranty covers defects in our labor only and does not cover parts, unless otherwise specified.
5.2 Parts Warranty
Parts warranties are provided by the manufacturer and vary by product. We will assist with warranty claims but are not responsible for manufacturer warranty policies or fulfillment.
5.3 Warranty Exclusions
Our warranty does not cover:
- Damage caused by improper use, abuse, or neglect
- Normal wear and tear
- Modifications made by others after our service
- Damage from accidents, racing, or off-road use
- Failure to follow recommended maintenance schedules
5.4 Custom Builds
Custom builds are unique projects and carry a 30-day workmanship warranty. Due to the custom nature of these builds, no warranty is provided for performance expectations, aesthetics, or resale value.
6. Customer Responsibilities
6.1 Accurate Information
Customers must provide accurate information about their motorcycle's history, previous modifications, and any known issues. Failure to disclose relevant information may void warranties and result in additional charges.
6.2 Parts Approval
Customers are responsible for approving all parts and modifications. We are not responsible for customer dissatisfaction with approved parts or modifications.
6.3 Pickup Timeliness
Customers must pick up their motorcycles within 7 days of completion notification. Storage fees apply after this period (see Section 4.4).
6.4 Test Riding
Customers acknowledge that test riding may be necessary to diagnose issues or verify repairs. By authorizing service, you consent to necessary test riding by our technicians.
7. Limitation of Liability
7.1 Maximum Liability
Our total liability for any claim arising from our services shall not exceed the amount paid by the customer for the specific service that gave rise to the claim.
7.2 Consequential Damages
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost profits or revenue
- Loss of use of the motorcycle
- Rental vehicle costs
- Inconvenience or emotional distress
- Damage to personal property
7.3 Third-Party Claims
We are not liable for any claims, damages, or losses resulting from your use of the motorcycle after our services, including accidents, injuries, or violations of law.
8. Intellectual Property
8.1 Website Content
All content on this Site, including text, images, graphics, logos, and code, is the property of Refugee Cycles and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.
8.2 Custom Build Designs
While the customer owns the physical motorcycle, Refugee Cycles retains intellectual property rights to custom designs, fabrication techniques, and build processes. We reserve the right to photograph and showcase our work for marketing purposes.
8.3 Photography Release
By commissioning a custom build or service, you grant Refugee Cycles permission to photograph your motorcycle and use those images for marketing, social media, and promotional purposes unless you opt out in writing.
9. Cancellation & Refund Policy
9.1 Customer Cancellations
- Before Work Begins: Full refund minus any parts already ordered (parts are non-refundable)
- After Work Begins: Customer is responsible for all work completed and parts ordered. No refund on deposit.
- Custom Builds: Deposits are non-refundable. Customer is responsible for all work completed if they cancel mid-project.
9.2 Our Right to Cancel
We reserve the right to refuse service or cancel a project at any time for reasons including, but not limited to:
- Non-payment or late payment
- Unreasonable customer behavior or demands
- Safety concerns or illegal modifications
- Lack of availability of necessary parts or expertise
In such cases, we will refund any unused portion of payment, minus costs already incurred.
10. Safety & Compliance
10.1 Legal Compliance
All services are performed in compliance with applicable federal, state, and local laws. We will not perform illegal modifications or services that would render a motorcycle non-street-legal without customer acknowledgment.
10.2 Emissions & Inspections
Performance modifications may affect emissions compliance and inspection status. Customers are responsible for ensuring their motorcycle meets all legal requirements for their intended use.
10.3 Racing Modifications
Modifications for racing or off-road use may not be street-legal. Customers acknowledge that such modifications are for "off-road use only" and assume all responsibility for compliance with vehicle codes.
11. Dispute Resolution
11.1 Good Faith Resolution
In the event of a dispute, both parties agree to make a good faith effort to resolve the issue directly before pursuing legal action. Please contact us at info@refugeecycles.com to discuss any concerns.
11.2 Mediation
If direct resolution fails, both parties agree to attempt mediation before pursuing litigation. Mediation costs will be shared equally.
11.3 Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action must be filed in the courts of Travis County, Texas.
11.4 Arbitration
For disputes exceeding $10,000, both parties agree to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitrator's decision is final and binding.
12. Indemnification
You agree to indemnify, defend, and hold harmless Refugee Cycles, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the motorcycle after our services
- Your violation of these Terms
- Your violation of any laws or regulations
- Your infringement of any third-party rights
13. Assumption of Risk
Motorcycles are inherently dangerous. By using our services, you acknowledge and accept the risks associated with motorcycle operation, including but not limited to:
- Increased risk of injury or death
- Risks associated with performance modifications (increased speed, handling changes, etc.)
- Mechanical failures, despite proper maintenance
- Environmental and road hazards
You assume all risks associated with operating your motorcycle and release Refugee Cycles from liability for injuries or damages sustained while riding.
14. Insurance Requirements
Customers are required to maintain adequate insurance coverage on their motorcycles while in our possession. We maintain liability insurance for our operations, but are not responsible for damage from theft, fire, natural disasters, or other events beyond our control.
We recommend comprehensive coverage that includes:
- Liability insurance
- Comprehensive and collision coverage
- Custom parts and equipment coverage (for modified bikes)
15. Force Majeure
We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:
- Natural disasters (floods, fires, earthquakes)
- Acts of government or military authority
- Pandemics or public health emergencies
- Labor disputes or strikes
- Supply chain disruptions or parts shortages
- Utilities failures or internet outages
16. Entire Agreement
These Terms, together with any written service agreements or quotes, constitute the entire agreement between you and Refugee Cycles regarding our services. These Terms supersede all prior agreements, understandings, and representations.
No modification to these Terms will be valid unless made in writing and signed by an authorized representative of Refugee Cycles.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
18. Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver will be effective unless made in writing.
